Founder of the Indigenous People of Biafra, IPOB, and director of Radio Biafra, Nnamdi Kanu, was on Wednesday granted freedom by a magistrate court sitting in Abuja, following a motion filed by the prosecution to discontinue the case.
Kanu was being tried by the State Security Services, SSS, for terrorism-related offences.
Magistrate Shuaibu Usman in striking out the case said he had no option but to free the suspect since the prosecution signified its intention to discontinue with the case.
Moses Idakwo, counsel to SSS, said following some investigations, it was discovered that a magistrate court lacks jurisdiction to prosecute the case.
This, however, does not mean the end for Kanu, who is also being tried at a Federal High Court.
Idakwo on Monday told the Federal High Court in Abuja that the Radio Biafra director was sponsoring terrorism against Nigeria and thus should not be granted bail as sought by the defense counsel led by Vincent Obeta.
According to Idakwo, the SSS had evidence of bank accounts belonging to the suspect showing financial transactions related to terrorist acts against the country, adding that if granted bail, Kanu could flee the country as a result of his dual citizenship.
The ruling on bail application comes up on Thursday, December 17, 2015.
