FG sues First Bank MD, two lawyers for forgery

THE Federal Government has sued First Bank of Nigeria Limited, its managing director and three others for alleged forgery and breach of trust against the proprietor of Whiteplain British School, Francis Nwufor.

The charge was filed by the Federal Ministry of Justice against the First Bank of Nigeria, the bank’s managing director, the manager of the bank at its Utako branch, Muftau Ande; and Dibiaezue Chuks.

In the matter before Justice Jude Onwuegbuzie of a Federal Capital Territory High Court, the five defendants were accused of “forging a tripartite legal mortgage without the consent of Francis Nwufor, with intent to commit fraud.”



The defendants were accused of illegal dispossession of Nwufor’s property using the forged legal mortgage.

The prosecution counsel noted that in 2016, the defendants conspired to forge a legal mortgage without Nwufor’s permission, with the intention to commit fraud.




     

     

    According to the first count, the defendants were charged with forgery and criminal conspiracy contrary to sections 96 and 363 of the Penal Code.

    The prosecution counsel also stressed that the defendant had committed a breach of trust contrary to Section 311 of the Penal Code and, therefore, liable to be punished under Section 312 of the same law.

    Also, the defendants in a third count were accused of dispossessing Nwufor of his property while being entrusted with the tripartite legal mortgage.

    Justice Onwuegbuzie adjourned the case till May 8.
