NJC Recommends Sack Of Two Judges For Misconduct

The National Judicial Council, NJC, has recommended two judges for sack after finding them guilty of misconduct.

The two Justices, Ugbo Ononogbo of Abia High Court and Nasir Gummi of Zamfara High Court, were recommended for dismissal and retirement respectively for acts that constitute misconduct contrary to Sections 294 (1) and (6) of the 1999 Constitution.

Spokesman of the NJC, Soji Oye, announced the decision on Friday, adding that it was a resolution taken at the end of the NJC’s 80th meeting which held between December 14 and 15.

According to Oye, Justice Onongbo was recommended to Governor Okezie Ikpeazu of Abia State for dismissal and criminal investigation for compromising the judgments in Suit No: HOH/25/2013; Mrs Nnenna Enweliku and 4 Ors Vs Udensi Dike Udensi and 2 Others.

Justice Gummi on the other hand was recommended to Governor Abdulaziz Yari for compulsory retirement for failing to deliver judgement in Suit No: ZMS/GS/13/2013; Chiroma Vs Forte Oil Plc, almost twenty- three months after the final address by all Counsel in the Suit, contrary to the Constitutional Provisions that Judgements should be delivered within a period of 90 days.

The NJC is currently headed by the Acting Chief Justice of Nigeria, CJN, Walter Onnoghen.

The co-founder of a Tanzanian whistle-blowing website has been charged with obstructing an investigation after he refused to hand over the details of people who post on the site to the police.

Maxence Melo, a director of Jamii Forums message boards, was charged under a controversial cybercrimes law.

The government said the law would stop the spread of lies, sedition and pornographic material online, but critics say the law limits freedom of expression.

One US aid agency, The Millennium Challenge Corporation, MCC, cancelled nearly $500 million of funding in March partly on concerns over the enforcement of the law.

Tanzanians have been using the hashtag #FreeMaxenceMelo in protest at Melo’s arrest.

On Wednesday Tanzanian police took Melo to his office and home to search for the users’ details they wanted.

Melo’s lawyer told journalists that the search was against his consent and the police did not have a search warrant.

The Jamii Forums other co-founder, Mike Mushi, told newsmen that the police didn’t take anything but made copies of several documents.

Melo appeared at Kisutu court in Dar es Salaam on Friday, charged with obstructing an investigation and with failing to register the site with a co.tzdomain name.

The cybercrime law made it a legal requirement for all websites in Tanzania to have a co.tz domain name.

It was gathered that Melo’s bail hearing has been postponed until Monday.

After he was charged, he was sent to Keko Prison in the country’s economic capital, Dar es Salaam.

Technology journalist Tefo Mohapi says the website in question, Jamii Forums, has played a huge part in exposing corruption in Tanzania.

He says information posted on the site about corrupt deals had led to the resignation of a prime minister, the dissolution of a cabinet and several ministers losing their jobs.

The trial of a new technology which uses smartphones and tablets for diagnoses of diseases and drug prescriptions for children under the age of five has been rolled out in Adamawa State by the International Committee of the Red Cross, ICRC.

The initiative which is a collaboration of the ICRC, the Swiss Tropical and Public Health Institute, Swiss TPH and the Adamawa Primary Health Care Agency, will be piloted by medical workers in ICRC-supported primary health care facilities in Adamawa state.

A statement by the Red Cross noted that the aim of the scheme is to improve the performance of healthcare workers by providing standardized procedures for the management of common medical issues.

The Coordinator of ICRC’s health activities in Nigeria,  Hashemi Padshah, said: “This new smartphone-age tool could become an essential and valuable part of ensuring a successful medical diagnosis and treatment plan for children in Nigeria.”

The new technology, known as the ALgorithm for the MANAgement of CHildhood illnesses, ALMANACH, is an upgraded electronic version of the IMCI – Integrated Management of Childhood Illnesses – an initiative that focuses both on curative care and the prevention of disease.

Padshah stated that “Given the ICRC’s work in war-torn countries, we have seen that a lack of appropriately trained health workers and diagnostic tools harms the quality of health care delivered to children under five years.

“Thanks to the use of ALMANACH, health workers can better diagnose diseases and prescribe appropriate medication.”

According to the Red Cross chief, “ALMANACH is also a data collection tool that can provide epidemiological surveillance information and lead to improved standards for the management of common diseases in Nigeria.”

The new technology was launched in Yola, the capital of Adamawa state, at an occasion attended by the Adamawa State Commissioner of Health, Fatima Abubakar, and Executive Chairman of Adamawa State Primary Health Care Development Agency, Abdulahi Belel.

Since 2015, the ICRC has supported seven primary health care centers in Adamawa state through the rehabilitation of damaged infrastructure, supply of equipment and drugs, as well as training for health workers.

The Kremlin has described the claims by the United States that Russia hacked into its official emails, as “indecent”, urging President Obama and the CIA “to either stop talking about this or finally present some sort of proof.”

US President Barack Obama has vowed to take action against Russia for its alleged interference in the US presidential election campaign.

“We need to take action and we will,” he told a US radio network NPR.

Russia stands accused by the US of hacking the emails of the Democratic Party and a key Hillary Clinton aide, which the Kremlin strongly denies.

Republican President-elect Donald Trump has also dismissed the claim as “ridiculous” and politically motivated.

The intelligence agencies say they have overwhelming evidence that Russian hackers linked to the Kremlin were behind the hacks.

On Thursday, a White House spokesman said President Vladimir Putin was involved in the cyber-attacks.

Hours later,  Obama said: “I think there’s no doubt that when any foreign government tries to impact on the integrity of our elections, that we need to take action and we will, at a time and a place of our own choosing.

“Some of it may be explicit and publicised. Some of it may not be.

“Mr Putin is well aware of my feelings about this, because I spoke to him directly about it.”

It is not clear what action the US intends to take, with Mr Obama leaving office on 20 January.

The disclosure of emails was embarrassing to the Democratic Party at a crucial point in the election campaign.

The CIA has concluded that Russia’s motivation was to sway the election in favour of Trump, but no evidence has been made public.

On Thursday, John Podesta, whose emails were hacked as head of Clinton’s campaign in October and November, criticised the FBI’s response to the alleged Russian hacking.

“Comparing the FBI’s massive response to the overblown email scandal [over Mrs Clinton’s use of a private email server] with the seemingly lackadaisical response to the very real Russian plot to subvert a national election shows that something is deeply broken at the FBI,” he wrote in an opinion piece in the Washington Post.

Also on Thursday, a security firm said a Russian-speaking hacker had penetrated systems at the US agency which certifies voting systems.

In early December, the hacker tried to sell more than 100 login credentials from the US Election Assistance Commission, the firm Recorded Future said.

The company said its researchers discovered the breach when monitoring underground electronic markets, and posed as a potential buyer to engage the hacker in conversation, before alerting law enforcement agencies.

Trump has accused the Democrats of fabricating Russian involvement to hide their embarrassment at the election defeat.

He has also long expressed admiration for Putin, and his pick for secretary of state – oil tycoon Rex Tillerson, who has worked closely with the Russian leader – has raised concerns.

The president-elect has been assembling his new administration and on Thursday he said he would pick lawyer David Friedman to be his ambassador to Israel.

Envoys Commend INEC Over Rivers Re-run Election

Top diplomatic envoys to Nigeria have praised members of the Independent National Electoral Commission, INEC, for its bravery and courage during the legislative re-run election that held in Rivers State on December 10.

This was contained in a joint state signed by the British High Commissioner to Nigeria, Paul Arkwright; United States Ambassador to Nigeria, Stuart Symington; French Ambassador to Nigeria, Denys Guaer; German Ambassador to Nigeria, Bernhard Schlagheck and EU Head of Delegation to Nigeria, Michel Arrion.

“We praise the bravery and commitment of those INEC staff who persevered in their work on the ground to ensure polls went ahead in the face of severe challenges,” the statement read, adding however that the envoys were worried by reports that “some INEC officials accepted payment to influence election outcomes.”

The diplomats who had prior to the Election Day raised concerns over the rising tension in Rivers state, stated that they “followed closely the conduct of the elections … and the days immediately following.”

The statement read further: “We are extremely concerned by the use of incendiary language, intimidation and violence by supporters of both the major political parties prior to and during the elections.

“We are saddened by the deaths reported of civilians and police officers who were present in the state.”

The foreign envoys called “for a transparent and full investigation into those deaths and other security incidents, including of credible reports that some elements of the security forces either obstructed the course of the elections or improperly influenced the results.”

They also stressed the importance for the leadership of all political parties and their supporters to allow future elections in Nigeria to hold peacefully.

Nyako’s Bid To Be Reinstated Governor of Adamawa Fails At Supreme Court

The Supreme Court has dismissed an appeal by the former Governor of Adamawa State, Murtala Nyako, who has been seeking order from the court to be reinstated as a governor of Adamawa State to enable him to complete his truncated second term.

Nyako was removed as governor of the state on July 15, 2014, about 10 months away from the expiration of his tenure.

The seven-man panel of the apex court led by Justice Tanko Muhammad held in its judgment that it agreed with the earlier decision of the Court of Appeal that declared Nyako’s removal from office as illegal, but that it was unable to reinstate him because of the “special facts” of the case while it was before the lower court.

The Supreme Court explained in its lead judgment read by Justice Dattijo Mohammed that the appeal failed because Nyako’s lawyer had compromised the case at the Court of Appeal by withdrawing the prayer seeking the ex-governor’s reinstatement.

Justice Mohammed held that a lawyer was entitled to “conduct, compromise or withdraw” his or her client’s case, but that there could be no ground of appeal when a litigant’s case was compromised by his or her lawyer.

“On that score alone the appeal fails,” Justice Mohammed ruled.

Punch reports that the Justice of the Supreme Court said the remedy approved by the appeal court by ordering the payment of salaries and other entitlements accruable to the ex-governor for the period he was illegally removed from office, was in order.

But he ruled that Nyako had to continue to bear as his cross the compromise of his case by his lawyer when the said counsel voluntarily withdrew the prayer for the ex-governor’s reinstatement before the Court of Appeal.

He ruled, “Because of the special facts enunciated in this appeal, that fact of compromising his case by his counsel is a cross that the appellant (Nyako) will continue to bear.

“So, there will never be a forum again where that issue of reinstatement would be raised again, and to that extent, that informs my dismissal of the appeal in its entirety.”

Justice Tanko Muhammad and other members of the apex court’s panel, comprising Justices Clara Ogunbiyi, Mary Peter-Odili, Chima Nweze and Amir Sanusi, agreed with the lead judgment prepared by Justice Dattijo Mohammed.

Respondents to Nyako’s appeals were the Adamawa State House of Assembly, the Chairman of the seven-man panel that recommended the removal of the ex-governor to the Adamawa State House of Assembly, Buba Kaigama, and the Inspector-General of Police.

Buhari Endorses Environment Minister For UN Top Job

President Muhammadu Buhari has endorsed the appointment of the Minister of Environment, Amina Mohammed, as the Deputy Secretary General of the United Nations.

This was made known by Presidential spokesman, Garba Shehu, who disclosed that the new UN Secretary General called the President on Thursday evening  to inform him of the development.

Shehu stated that President Buhari “used the opportunity to reiterate his support and congratulations to Mr Antonio Guterres on his upcoming tenure in the service.”

Buhari also endorsed the appointment of Mohammed, adding that “by her appointment, Nigeria has been honoured.”

The presidential spokesman added that the president “thanked Mrs Amina Mohammed for her untiring contribution to transform Nigeria.”

“President Buhari said he looked forward to sustained collaboration between the UN and Nigeria” Shehu stated, adding that “he had no doubt that she will continue to make Nigeria proud at the global level.”

Buhari later took to his own twitter handle where he posted: “I wholeheartedly endorse the choice of@AminaJMohammed as the next Deputy Secretary-General of the @UN. It is a great honour to Nigeria.”

According to Shehu, “It is expected that the Minister of Environment will be transitioning to her new role in March 2017.”

He added that until then, the minister “is expected (to) continue to lay strong foundations with various important ongoing initiatives critical to the government’s success in the Environment sector.”

Shehu listed some of the projects currently being worked on by the environment ministry to include the “implementation of our Nationally Determined Contributions (NDCs) under the Paris Climate Agreement, the successful launch of the Sovereign Green Bonds in 2017, the ongoing Ogoni cleanup (as well as the) development of the Great Green Wall.”

The new UN Secretary-General, António Guterres, announced the  Environment minister, as his Deputy Secretary-General on Thursday.

“I am pleased to announce that I will be appointing Ms. Amina J. Mohammed of Nigeria as my Deputy Secretary-General, and Ms. Maria Luiza Ribeiro Viotti of Brazil as my Chef De Cabinet,” Guterres had announced through his spokesman Stephane Dujarric.

Family Of Policeman Shot By Colleague Demands Justice

Family members of Salvation Adaka, a Police Sergeant, who was shot dead by his colleagues over N20,000 ‘largesse’ on November 7, 2016 have called on the Police authorities to prosecute the culprits.

It was gathered that Adaka and three of his colleagues from Agudama-Ekpetiama Police Division were on patrol duty on November 7 2016 and stopped over at a wake keep where they were rewarded with N20,000

Trouble however started when an argument ensued over the sharing formula for the gift received by Adaka, the most senior member of the patrol team and he was shot dead in the ensuing scuffle.

Joseph Yabefa, a representative of the family of the deceased policeman said on Monday in Yenagoa that the family just received the autopsy reports which confirmed that Adaka died of gunshots.

He said that the pathologist who conducted the post mortem and autopsy found pieces of the lethal bullets in the spinal cord of the deceased.

Yabefa who expressed satisfaction with the steps so far taken by the Bayelsa Police Command on the incident noted that the family is demanding the prosecution of the suspects.

He said: “We have been following developments on the case, our interactions with the police indicate that three of the Policemen with Adaka on that day were immediately arrested and detained.

“We were also told that one of them who was found not to be culpable have been released while two are still in Police custody awaiting prosecution while they have been discharged.

“Most importantly investigations have indicated that they were on official duty when the incident happened and not on illegal duty as being speculated in some quarters.

“We are still in grief because Salvation Adaka was a bread winner to the entire extended family including his immediate family; he has an aged mother, five children as well as elder and younger brothers that depended on him.

“We urge the Police to sustain the tempo and not to tamper with the evidences available that will form the basis of prosecution, we shall follow this matter to a logical conclusion,” Yabefa said.

Sources at Bayelsa Police Command confirmed that the two policemen indicted in the case have been dismissed from service.

Asinim Butswat, Spokesman of Bayelsa Police Command however said on telephone that discipline and sanction of the three policemen lies within the administrative powers of the Bayelsa Police Commissioner.

Buhari Commissions New War Ship, NNS Unity

President Muhammadu Buhari was in Lagos this Thursday to commission the latest addition to the fleet of Nigerian war ships, NNS Unity, which was acquired by the Nigerian Navy from the Peoples Republic of China.

The President also commissioned a Seaward Defence boat, ‘NNS Karaduwa’ as well as a Tugboat named ‘Commander Edwin Ugwu’ which according to Naval authorities were built by indigenous engineers at the Nigerian Navy Dockyard, Lagos and the Naval Shipyard, Port-Harcourt.

Buhari commended the government of China for “the mutually helpful military cooperation, of which the Nigerian Navy has been a major beneficiary.”

He noted that NNS Unity was “the second of such acquisitions from the Peoples’ Republic of China and is a product of Nigeria’s growing relationship with China.”

He also recalled how China had donated “an offshore patrol boat to the Navy at the time of taking delivery of the sister ship of Nigerian Navy Unity last year.”

President Buhari praised the Nigerian Navy for its “great foresight” not only in acquiring new and modern war ships, but also for not relying on foreign sources “but have braced up to take your destiny in your own hands by embarking on aggressive local complement provision to assemble your fleet.”

He also commended the Navy for its impressive strides in the area of continued fight against maritime security threats like piracy, oil theft, illegal bunkering and pipeline vandalism, as well as its involvement and contribution in the on-going fight against insurgency in the North East.

The President pledged that his administration will continue to support the Navy within the limits of available resources “through improved training, provision of modern equipment, infrastructure and attention to welfare.”

“I hasten however to remind you that we are at a critical period when the country faces dwindling revenues. The moment therefore calls for prudent resource management and patriotic re-dedication. I am accordingly encouraged by the steps you have taken so far,” the president said.

House Of Representatives Probes Illegal Logging By Chinese

The House of Representatives is investigating allegations that Chinese nationals are causing deforestation by engaging in tree-cutting and illegally exporting woods out of the country.

An ad hoc committee chaired by Bede Uchenna-Eke said on Thursday that the act was a major factor contributing to the fast depleting forest reserves in the country and the negative impact on the environment.

Citing “massive deforestation and alleged corruption”, the committee revealed that though the activities of the Chinese and other illegal wood theives were reported to security agencies, particularly the police, it appeared that no serious measures had been taken to halt the trend.

Eke said the committee would summon the Inspector-General of Police,  Ibrahim Idris, to brief lawmakers on measures he had taken to address the illegal acts.

An investigation published by www.icirnigeria.org on January 18, 2016 detailed how corruption by local officials and sharp practices by Chinese businessmen drive a thriving illegal trade in timber from Nigeria and a large part of West Africa with grave consequences for the economy, ecosystem and the environment.

The report titled, “How China Fuels Deforestation In Nigeria, West Africa” revealed that in many states, including Kogi, Ekiti, Ondo, Ogun, Taraba, Kaduna, Adamawa and Cross River, a rapacious demand by China for an ornate species of wood, rosewood (Pterocarpus erinaceus), locally known as Kosso, has, since late 2013, fuelled an unprecedented frenzy of illegal logging of wood that is fast depleting the nation’s natural forestry resources.

The report indicated that timber merchants working for Chinese businessmen are moving from one state to another depleting the rosewood resources in their forests, leaving blighted and raped landscapes without minding the enduring effects of unrestrained harvesting of the product on the environment.

The story also detailed how the unprecedented demand for rosewood in Nigeria is driven by a rapacious need by China to feed a taste for ornate and luxury furniture by the country’s burgeoning middle and upper class.
