The All Progressives Congress, APC, might be facing a crisis as the running mate to Audu Abubakar in last Saturday’s governorship election in Kogi State, James Faleke, has asked the Independent National Electoral Commission, INEC, to consider him as the party’s candidate in the supplementary poll scheduled for December 5.
Faleke, through his lawyer, Wole Olanipekun, on Thursday wrote a letter to INEC arguing that with the death of his principal, the votes cast at the polls and announced cannot be usurped by another candidate who did not participate in the process.
“In law and logic, no new candidate can inherit or be a beneficiary of the votes already cast, counted and declared by INEC before that candidate was nominated and purportedly sponsored,” the letter reads.
“Assuming without conceding that INEC is even right to order a supplementary election, the votes already cast, counted and declared on Saturday, 25th November 2015, were votes for the joint constitutional ticket of Prince Abubakar Audu and our client.”
This is coming as the APC leaders in Kogi East Senatorial District decided to replace Audu with his first son, Mohammed, as the party’s governorship candidate in the supplementary election scheduled for December 5, 2015.
The APC, which is leading in the results so far announced by more than 40, 000 votes, has decided to conduct a new primary to choose who represents it in the supplementary election.
The APC in Kogi East Senatorial District has thrown its weight behind the junior Audu and urged the national leadership of the party to do same in the interest of the state.
Daniel Isah, spokesperson for the Kogi East APC, announced the support for Mohammed Audu, 43, on Thursday in Lokoja after what he called due consultations.
