ALAKIO MASSCRE: Panel Indicts Ombatse Group Over Killings

The Judicial Commission of Enquiry set up to probe the May 7, 2013 massacre of security men in Alakio, Nasarawa state has given a damning indictment of the Ombatse group which it described as an evil cult that engages in killing innocent citizens.

However, the indictment is not contained in any report or white paper but in an affidavit filed before a Nasarawa State High court in response to a suit filed by the group’s counsel Zachary Zamani Alumaga.

In the suit filed by Alumaga on behalf of the group, he sought for reliefs for the safeguard of its fundamental human rights and an injunction to stop the commission of enquiry from submitting its report and the state government from receiving the report and releasing a white paper on it.

In a detailed counter affidavit filed by the commission, through its secretary, Abubakar Sadiq Ishaq, who is the permanent secretary Cabinet Affairs in the Office of the Secretary to the State Government, SSG, the probe panel accused the Ombatse group of perpetrating evil which has held the state to ransom.

Abubakar who declared that he was working under the authority of the commission’s chairman and other members said that it received a total of 22 memoranda and found the Ombatse group culpable of the offences levelled against it.

The secretary stated further that from the 22 memoranda it received,  it was “revealed that the ombatse group proscribed by the state government is opposite of what the applicant (Allumuga) claimed the group represents as deposed in paragraph 5,6,7,8,9,10,12,13 and 14 of the said supporting affidavit of the Ombatse.”

Continuing, he said that “the memoranda received from various communities and persons that were attacked by Ombatse group showed that the ombatse group is an ethnic militia that engages in killing, maiming, looting and dangerous acts that are inimical to good government, peace, and security of Nasarawa state.”

The commission’s secretary stated that despite the proscription of the group, it continued to unleash terror, mayhem, killing and destruction of lives and properties in the state.

He described the suit filed by Ombatse as useless as, according to him, the group cannot “demonstrate any wrong done to, to be done, or likely to be done to the applicant by the commission to necessitate the action filed against the commission”.

In a second counter affidavit filed by the permanent secretary of the state planning commission Suleiman Muhammed , in support of Al – Makura, the governor countered the claim made by Alumaga that the group is out to promote peace and cleanse the ills of the society, saying the an “ethnic militia that engages in killing, maiming,looting, and doing other dangerous acts that are inimical to the good government, peace and security of the state.”

Responding to the allegation raised by group’s lawyer that Governor Al-makura’s representative was at one of its gathering after its proscription, the permanent secretary said he represented the governor at the occasion because they were informed that the group was ready to turn a new leaf.

His affidavit reads in part:

“On the 2nd of February 2013, i was with the Governor of Nasarawa State whereof he informed me  and i verily believe him to be true that the Ombatse group had realized that what they have been doing threatening the peace and security of the state in particular blocking of public high ways and molesting passersby and innocent Nigerians on 17th of November 2012 was illegal, unlawful and regrettable and that they were now remorseful and want to turn over a new leaf and to be reintegrated into the society”.

“That the members of Ombatse group through their leaders have invited him tto visit them and receive them and integrate them into society. That he was preparing to go there and receive them since the Ombatse group has turned over a new leaf according to them. That the governor could not make the journey due to other pressing state matters whereof i was directed by His Excellency to represent him and receive them. That i was given phone number of the person to call to direct me to the venue of the place prepared to receive the Governor of Nasarawa State. That i was directed , i got to the venue , i met chairs and canopies well arranged to receive the governor and not any prayer ground as falsely depose by the applicant.

“That on getting to the venue i was introduced to the gathering and their spokesperson said that they were happy that the governor was willing to receive them back into the society to be reintegrated as useful persons and citizens. That i responded by welcoming their ideals of renouncing the conduct that is inimical to peace, and development and that he governor is happy with the ideas of repenting from their evil ways and it was due to that, that he sent me to represent them. That after all said and done, they made two requests that day to the effect that they needed the hospital in Nasarawa Eggon to be fenced and that i should plead with the governor to intervene for the release of some of their members that were arrested by security operatives,” he said.

In another counter affidavit to Alumaga’s claims, the law firm of  J.S Okutepa SAN,  also representing the governor, Al – Makura urged the judge to dismiss the application filed by Ombatse legal adviser seeking for redress of the abuse of their fundamental human right.

He declared that the Ombatse group “has woefully failed to make out a case under the Fundamental Human Right Enforcement Procedure Rules, or any other law for that matter to be entitled to any of the reliefs sought”.

Okutepa noted that “the ombatse group on whose behalf the claim is brought is neither a registered association nor a human being, nor known to law and is therefore devoid of any jurist personality to bring an action or authorize the filing of an action either in its name or in the name of any of its members”.

He posited that the court cannot speculate on Ombatse’s membership as they are undisclosed, unknown and consequently non-existent.

“The question to be asked is whether a non-existent person can authorize an act? It is not a doubt that this action is purportedly filed by Zachary Zamani Alumuga for himself and on behalf of the group. There is nothing to show that the Ombatse group is a legal person, capable of suing and being sued, he posited.

Okutepa however, admitted that legislative process may not have been followed in the law that proscribed Ombatse but added it doesn’t amount to the abuse of fundamental human right.

“Even if there was a failure to follow due process, which is not conceded, such failure we submit does not grant a cause of action under a fundamental human right enforcement procedure. It is not a fundamental right question to fail to follow a process in making law”, he declared.

The counsel to the  governor also said that the Ombatse group lack substantial evidence to seek relief from court.

“The case of the applicant will be bereft of evidence upon which this court can grant the relief sought by the applicant. It is the duty of any party seeking declaratory reliefs to furnish sufficient evidence as those reliefs cannot be granted for mere asking,” he said.

Reacting to the submissions of the  commission and the governor, Alumaga said their response to affidavit has pre-emptied the report of the commission.

“It is very unfortunate that the commission’s report has been pre-emptied. The terms of reference of the commission is saying go and find out the involvement of ombatse members. Go and find out how involved they are. And the commission is saying that Ombatse is engaged in killing, destruction, maiming and arson. That is what the secretary of the commission deposed to in his counter affidavit and found as a fact. And he said he has the authority and consent of the chairman and members of the commission to depose to the affidavit.

“In his disposition, he said he knows that ombatse group in spite of the ban is still going on and its activities are to kill, to maim, to destroy and to cause arson. If the commission is of that position, that is their disposition. And that was what they were asked to find out. The only aspect of the commission’s report remaining now is who and who are members of Ombatse that’s all”, he stated

The legal adviser also disclosed that the rationale behind his suing the governor and commission to court was the injustice perpetrated by the commission’s chairman during the proceedings, giving an instance of how the commission’s chairman shielded the governor over the N1million gift he gave to the sect.

He  added that the conduct of the chairman and members of the commission made him to lost confidence in the report of the commission.

Allumuga also debunked Governor Al-makura’s claim that the presence of his representative at Alagoni hills on February 2, 2013 was to reintegrate the group back to the society saying the governor’s representative was at the prayer ground to promise them logistics that would aid their activities.

He added that a video clip would be produced in due time to substantiate his claims. On the issue raised by Okutepa that Ombatse group is not a registered group and thus cannot sue or be sued, Alumuga said he would remain silent for the court to determine its status..

In the suit, the Ombatse group opposed their proscription saying the Nasarawa State Notice No.4 of 2012 made by the governor of the state is illegal, unlawful and unconstitutional.

According to Alumaga, the rationale for their assertion is because neither he, the counsel, nor any member was invited to be heard before the proscription was pronounced.

He declared that by virtue of Section 40 of the 1999 Constitution of Nigeria, the Ombatse group has the right and freedom to assemble freely and to associate with others.

The legal adviser is asking for an order of the court nullifying the proscription the group and giving them liberty to operate without restrictions. He also prayed the court to restrain the governor and the commission of inquiry from interfering with their liberty, rights and privileges of the Ombatse group.

Alumaga also sought for an injunction to restrain the attorney general of the state and Nasarawa State government from receiving and implementing report of the of the commission because the commission was set up on a faulty law.

An award of Five hundred million naira was also requested by the group for breach of their fundamental human right.

Police Promotes 2 AIGs, 3 Commissioners

The Inspector-General of Police, Mohammed Abubakar, has announced the promotion of two  Assistant Inspectors-General of Police, AIGs and three commissioners of Police, CPs.

According to a statement signed by the police 0ublic relations officer, Frank Mba, a chief superintendent of police, Michael Zuokumor and Jonathan Johnson who were formerly AIGs in charge of Zone 4, Makurdi and Zone 6, Calabar, respectively, have been promoted to the rank of Deputy Inspector-General of Police, DIGs.

Similarly, Fana Abdullahi Salisu,in charge of Force Quartermaster, Musa Abdulsalam Daura, CP Kano and Kakwe Christopher Katso, CP Force CID, have been elevated to the rank of AIG.

Their promotion, according to the statement, followed the retirement of DIGs Marvel Akpoyibo and Philemon Leha, who were pulled out of the force on January 16.

The Inspector General of Police, M.D. Abubakar congratulated the newly promoted officers and urged them to re-double their efforts in the war against terrorism.

He also urged them to regard their elevation as an invitation to greater responsibilities.

Catherine Samba-Panza Emerges CAR’s Interim President

Lawmakers in Central African Republic, CAR, on Monday chose the mayor of Bangui Catherine Samba-Panza, to become interim president and lead the country out of months of sectarian killings towards elections.

Samba-Panza called on mainly Muslim former rebels and the Christian militia battling them to lay down their weapons as people sang and danced on the streets of the riverside city, Bangui, in celebration.

The 59-year old succeeds Michel Djotodia, leader of a mostly Muslim rebel coalition, Seleka, that seized power in March.

Djotodia stepped down this month under international pressure after failing to halt bloodshed that erupted after the revolt.

Waves of killing and looting by Seleka fighters triggered revenge attacks by Christian militia known as ‘anti-balaka’, fuelling unprecedented cycles of violence between communities that had previously lived side-by-side.

“I am the president of all Central Africans, without exception,” said Samba-Panza, who had to show she had no link to either camp in the fighting to qualify for the post.

“I appeal to my anti-balaka and Seleka children to listen to me and together lay down your weapons,” she added.

Samba-Panza defeated seven other candidates in Monday’s contest, winning a second-round runoff by 75 votes to 53 for her closest rival Desire Kolingba, the son of former president Andre Kolingba.

Nigeria’s ruling People’s Democratic Party, PDP, has finally unveiled former governor of Bauchi State, Adamu Mu’azu, as its new chairman.

Ma’azu was picked as a consensus candidate at a meeting between President Goodluck Jonathan and party members which held at the Presidential Villa, Abuja on Sunday night, spilling into the early hours of Monday morning.

Incidentally, Mu’azu was last week sworn in as the chairman of the National Pensions Commission by Jonathan.

Mu’azu was born on June 11, 1955 and was governor of Bauchi State   from May 29, 1999 to May 29, 2007.

The newly appointed chairman has promised to respect the governors of the party, saying: “I won’t tamper with your structure in your states.”

Muazu admitted that the party was deeply hurting and has pledged to do his best to doctor it back to health.

“In the last few months, the PDP has occupied front pages of our newspapers with negative screaming headlines. Most political analysts predicted that the end of the game has come. There is no doubt that all has not been well with our party. However, the crisis that has rocked the party is a common phenomenon with large parties,” he noted.

However, a pall of controversy hangs on the new PDP chairman as the Economic and Financial Crimes Commission, EFCC is is prosecuting Mu’azu for allegedly stealing billions of naira belonging to Bauchi State during his two term tenure as governor.

N4.7 Billion Fraud: Court Adjourns Wale Babalakin’s Trial Till Feb

An Ikeja High Court in Lagos on Monday adjourned the trial of the Chairman of Bi-Courtney Ltd., Wale Babalakin, till February 17, to enable the defence lawyers regularise applications filed before the court.

Babalakin is being prosecuted for an alleged N4.7 billion fraud by the Economic and Financial Crimes Commission, EFCC.

The EFCC had charged him, alongside Alex Okoh and their companies – Stabilini Visioni Ltd., Bi-Courtney Ltd. and Renix Nigeria Ltd. – on 27 counts for allegedly laundering money on behalf of convicted former Delta State Governor, James Ibori.

During Monday’s proceedings, the judge, Justice Lateef Lawal-Akapo, informed the parties that he needed time to examine some of the processes filed by the defence lawyers.

“Apart from Roland Otaru (counsel to the third defendant), all the other applications were brought to my attention about 20 minutes ago. In a matter of this nature, it is always good to study the processes and ask pertinent questions as the matter goes along,’ he said.

The judge therefore adjourned the case till February 17 for further hearing.

Nigerians Flee To Niger Republic To Escape Boko Haram Attacks

Hundreds of Residents of Mobbar, Gashigar and Malumfatori communities in Borno State have fled to neighbouring Niger Republic to escape incessant attacks by the outlawed Boko Haram sect, leaving the communities deserted.

The residents of the affected areas have also appealed to the federal government for help in putting an end to the wanton killings by the Boko Haram sect.

So far, 15 lives have been lost following several attacks, the latest being the attack on Thursday on Gashigar, a fishing community which shares boundary with villages in Niger Republic, in which seven persons were killed and over 60 shops and eight vehicles razed.

The villagers allege that the situation is worsened by the absence of security operatives in the community, leaving their safety in the hands of the civilian JTF.

The immediate former vice chairman of Mobbar local government, Talba Gashigar, narrated the incident to journalists on Sunday.

The Borno State Police Command confirmed the incident to journalists, but debunked claims by the villagers that there was no police presence in their area.

The Police public relations officer, Gideon Jibrin, said there is always police presence Mobbar local government and surrounding villages.

Over N78 billion Lost Annually on Foreign Medical Trips

Nigeria loses over N78 billion yearly through capital flight by individuals and public officials who seek medical treatment abroad, the minister of health, Chukwu Onyebuchi, has said.

Onyebuchi who was speaking in Benin, Edo State, at the burial ceremony of the father of the president of the Nigeria Medical Association, NMA, Osahon Enabulele, said the trend has become worrisome, more so because some of those who seek foreign medical attention end up being detained over their inability to pay their bills.

“There are some Nigerians detained in other countries because they could not pay for their medical bills , some of them, their communities have written me letters for financial assistance because they cannot come back to Nigeria because they are owing. It is a big problem,” he said.

The minister, however, disclosed that the federal government has initiated a policy that will help curb this trend, as it will ensure that only those whose cases cannot be handled in Nigeria or who are financially capable are allowed to seek foreign medical help.

According to him, the new policy would require the approval of the minister of health before public servants at the federal or state levels can go abroad for treatment.

“If what you are going for can be done in Nigeria we would not spend public money. However, we must also recognise the individual rights of human beings. If you have your own money you are free to seek medical care anywhere,” he said.

Onyebuchi also urged Nigerians to take advantage of the National Health Insurance Policy which he said should be made compulsory by all employers of labour for their employees, noting that the country’s health sector had tremendously improved and there was need to encourage local practitioners.

He said for more than 10 years, no Nigerian hospital could perform an open heart surgery but that in the last one year, two hospitals,  the University College Hospital, UCH, Ibadan and the University of Nigeria Teaching Hospital, UNTH, Enugu, have successfully accomplished this feat.

Ihejirika Faults Northern Leaders On Calls For His Trial At The ICC

The immediate past Chief of Army Staff, Azubuike Ihejirika, has criticised the call made by the Northern Elders Forum, for his trial at the International Criminal Court, ICC, for the alleged killing of defenceless civilians in Bama, Borno State by soldiers of the Joint Task Force, JTF during a recent operation.

Ihejirika  who spoke to state house correspondents after a church service held at the Presidential Villa’s chapel on Sunday, said rather than making such a call, which is based on misinformation, the elders should express gratitude to the military which had sacrificed a lot to protect the Northern region and the country at large.

The former army chief noted that there is no senatorial zone in the country that has not lost personnel in the armed forces, adding that the northern leaders had not bothered to send a single condolence message to the military, in spite of its huge sacrifices.

“We have sacrificed, first, to see that Nigeria is safe and the north in particular, since they are the first beneficiaries of the sacrifices being made. It is unfortunate that the same elders, if they are really elders, have not cared to send a single condolence message to the military,” Ihejirika said.

He described the call made as discouraging, saying it would impact negatively on counter-terrorist efforts.

“As we speak now, there are soldiers that have not had a meal since yesterday because of the peculiarity of where they are at the moment,” he said.

According to him, the fight against terrorism had been tasking but results are being achieved.

“It has been a very busy thing and I believe that, very soon, Nigerians will be very happy because we have put quite a number of structures in place. I want to say that with some equipment and training that were carried out in recent days, there will be little or no hiding place for the insurgents,” he added.

The elders forum had on Friday threatened to drag the former army chief and six other unnamed persons before the International Criminal Court at the Hague for serially killing civilians in Bama and Giwa Barracks.

According to its spokesman, Ango Abdulahi, the forum made the call based on the evidence of two committees of legal and security experts it set up to “investigate the details of the gruesome use of force against unarmed civilians in Bama and other parts of Borno State.”

“At our meeting in Kaduna on the 15th January, 2014, we received the reports of the two committees on security and legal matters, regarding extra-judicial killings by soldiers in Bama and the act of strangulating civilians in Giwa Barracks using an underground detention centre, while depositing the corpses in hospital.

“The Forum has therefore resolved to harmonise the reports of the two committees, preparatory to filing a case of extra-judicial killings by the Nigerian Army under the then Chief of Army Staff, Lieutenant-General Azubuike Ihejirika and six others. The reports will be harmonised at our emergency meeting in Abuja on Wednesday the 22nd of January 2014 for further action,” Abdulahi said.

The Bama incident occurred on Tuesday May 7, 2013 when suspected members of Boko Haram unleashed terror on residents, killing many people.

The casualties included 13 officers of the Nigeria Prisons Service who were killed during a raid on the Bama prisons by the terrorists where about 105 inmates were set free by the insurgents.

The army authorities said at the time that the terrorists who carried out the attack wore military fatigue and were armed with high calibre arms and ammunition.

Kano PDP Dissolves Executive Committees In LGs, Wards

The Peoples Democratic Party, PDP, in Kano State on Sunday dissolved the executive committees of the party in all the 44 local government areas and 484 wards in the state.

The dissolution was contained in a statement signed by the party’s interim chairman and secretary, Hassan Kafayos and Andrew Musa respectively, in Kano.

It said the action was necessary because the state governor, Rabiu Kwankwaso, had before his exit to join the All Progressive Congress, APC, turned the party into the “Kwankwasiyya political movement”.

The statement alleged that the movement made the party to lose its capacity as a political body.

According to the statement, the chairmen of the caretaker committees of the party in the 44 local government areas had been appointed and would soon be announced.

It however said the caretaker committee members of the local government areas and the entire executive committees of the wards would be reconstituted after due consultations with stakeholders.

World Mourns BBC TV Presenter Komla Dumor

The entire country of Ghana was thrown into mourning Saturday as the news of the sudden death of Ghanaian BBC TV presenter, Komla Dumor, was announced by the broadcast station.

Dumor was said to have died at his home in London from what seems like a heart attack at age 41.

Ghanaian President John Dramani Mahama said that his country had lost one of its finest ambassadors.

Describing him as a “friend, a brother and a patriot,” the president said “Komla was a hardworking, dedicated and consummate professional, who blazed a trail, from his days of great success as Ghana’s most popular broadcaster with Joy-FM in Accra, where he won the Ghana Journalist of the Year award, to his inspiring rise at the BBC in London.”

Mahama said Ghana, Africa and indeed the world have lost a great, dedicated and wonderful human being and world broadcaster.

“On behalf of my government and the people of Ghana, I wish to express my deepest sympathies and condolences to his wife, Kwansema and the children and also to his father, Professor Ernest Dumor, his siblings Mawuena and Korshie the entire family,” he said.

Justice Lee Adoboe wrote from Accra, Ghana: “Komla was the trailblazer of modern radio journalism in Ghana. He was the icon, most of us local journalists looked up to, for inspiration. May he rest in peace.”

Many others who had interacted with the ace reporter or simply admired him from afar took to their twitter handles to express their grief at the sudden loss.

“I first met Komla while we were both students at the University of Ghana around 2000-2001. He was working at JOY FM while still studying at the time. He was affable, friendly and had a good sense of humour… He made a mark on radio journalism in Ghana, and was a great source of inspiration for many Ghanaian youth, especially, those who wanted to get into radio. May his soul rest in peace,” said Emmanuel, New York City, USA.

“I never knew him personally but always looked forward to his posts on Facebook. My Facebook page will not be the same without him. Every Ghanaian loved him and we still do. Forever in our hearts. The BBC reports that the Ghana-born presenter had suffered a heart attack in the past.

Dumor joined the BBC in 2007 and became a presenter for BBC World News and its Focus on Africa programme.

BBC Global News director, Peter Horrocks called Dumor a leading light of African journalism who would be deeply missed.

“He was committed to telling the story of Africa as it really is. Africa’s energy and enthusiasm seemed to shine through every story Komla told,” Horrocks said.

BBC director of News and Current Affairs, James Harding, spoke of Komla Dumor’s singular role in transforming the coverage of Africa.

“He brought a depth of understanding, a great deal of courage, a joyous charm and boundless charisma to his work,” Harding said.

Dumor had a wide-ranging career as an interviewer and presenter. He won the Ghana Journalist of the Year award in 2003 and joined the BBC four years later.

From then until 2009 he hosted Network Africa for BBC World Service radio, before joining The World Today programme.

In 2009 Komla Dumor became the first host of Africa Business Report on BBC World News. He was a regular presenter of Focus on Africa and had fronted the programme the day before he died.

He travelled across Africa, meeting the continent’s top entrepreneurs and reporting on the latest business trends around the continent.

He interviewed a number of high-profile guests including Bill Gates and Kofi Annan.
