Justice Mohammed Idris held that the Administration of Criminal Justice Act, ACJA, provides for a heavier sentence for the crime to which the accused pleaded guilty.
Omoile was on Monday arraigned by the Economic and Financial Crimes Commission, EFCC, on a two-count amended charge of conspiracy and money laundering.
Chairman of the House Committee on Justice, Razak Atunwa, said: “We cannot ignore such weighty allegations (against Jonathan) knowing fully well that Nigeria has lost billions of dollars as a result of the numerous complications around the OPL 245 oil field."
According to the charge sheet, the former Minister, was described as “still at large”, while the names of the other accused persons were given as Christian Nwosu, Yisa Olarenwaju and Tijani Bashir.
