
The Court of Appeal in Yola, the Adamawa State capital, on Thursday nullified the impeachment of former governor of the state, Murtala Nyako.
The court ruled that the impeachment was not done in consonance with the law as the governor was not physically served the impeachment notice and also denied fair hearing.
Nyako was impeached for gross misconduct and corruption on July 16, 2014, after 17 of 25 members of the state House of Assembly adopted the report of a panel set up to investigate allegations of corruption against him.
Consequently, the court in a judgment read by Justice Tunde Ayotoye ruled that all the benefits privileges due to the former governor be accorded to him, including all his entitlements through the period he was forced out of office.
The court, however, struck out Nyako’s appeal for reinstatement as governor because his tenure has already elapsed.
